ELECTRONIC TICKET (for ticketed excursions)

The electronic ticket is a non-physical ticket. For all bookings, you must present your booking confirmation document, the “confirmation email”, which serves as your electronic ticket.

CANCELLATION TERMS FOR YOUR EXCURSION

- Due to Eco-Calanques (ENM):

– In the event of a proposed programme change

The weather may sometimes not allow the standard itinerary to be followed, but may still allow for great sailing in another direction. In this case, the captain and the Eco-Calanques (ENM) team may propose a change of itinerary before departure.

– If the change of itinerary is accepted, the client will take part in the full day and will not be entitled to any refund or reduction thereafter

– In the event of refusal, the client will not take part in the day and will be fully reimbursed.

If, due to bad weather conditions, the excursion could not take place at all, you would be fully reimbursed for any sums paid, and no charges would be retained. The captain and/or crew of Eco-Calanques (ENM) is/are the sole decision-maker(s) as to whether or not to cancel the excursion.

– Due to the client:

If, for personal reasons, you choose to cancel your excursion one week before the date of the excursion, your deposit will be refunded and no charges will be retained.

Should you need to cancel your excursion between 6 and 3 days before the date of the excursion, we will retain up to 50% of the total cost of the excursion.

Should you need to cancel your excursion less than 3 days before the date of the excursion, the full amount received will remain with us.

TERMS OF THE EXCURSION

Eco-Calanques (ENM) reserves the right to modify routes or cancel services in the event of bad weather conditions. Only the captain is authorised to judge navigation conditions and may cancel a maritime service. In the event of cancellation by Eco-Calanques (ENM), passengers may be reimbursed, or the excursion may be postponed to another date with your agreement.

Swimming is permitted during stops, at your own risk. Under no circumstances can the loan of swimming equipment be considered a supervised water activity.

Passengers undertake, in all circumstances, to comply with the on-board regulations established by Eco-Calanques (ENM), and to follow the instructions of the captain and their crew. Passengers must arrive 15 minutes before the departure time. No refund will be given in the event of a passenger's late arrival.

TRANSPORT TICKET AND ACCEPTANCE OF CONTRACTUAL TERMS:

Making an online booking on the Eco-Calanques (ENM) website constitutes a contract which implies acceptance of these general terms and conditions of sale and transport by all participants in the nautical and aquatic activities offered by Eco-Calanques (ENM), on whose behalf the booking has been made.

The e-ticket, which corresponds to the online (or email) confirmation of your booking with Eco-Calanques (ENM), is personal and non-transferable. It must be kept by the customer who made the online booking for one or more people.

PASSENGERS' HEALTH STATUS:

Passengers must inform Eco-Calanques (ENM) of any contraindication or unfitness that could prevent them from taking part in the services it offers (nautical activities: sea excursions, water sports, swimming, snorkelling, etc.).

Passengers board at their own risk and may not hold Eco-Calanques (ENM) liable in the event of personal injury linked to their state of health (disability, illness, etc.), whether on board, during boarding or disembarkation, or during nautical or aquatic activities.

Passengers who, due to their state of health, require special assistance during the excursion or nautical and aquatic activities (persons with reduced mobility, visually impaired persons, etc.) are invited to inform Eco-Calanques (ENM) crew when booking and upon boarding.

PREGNANT WOMEN:

Pregnant women may take part in a sea excursion, entirely at their own risk.

However, they may not hold Eco-Calanques (ENM) liable for any reason whatsoever in the event of personal injury.

Eco-Calanques (ENM) cannot be held liable in the event of personal injury or any other incident linked to pregnancy.

MINORS:

Eco-Calanques (ENM) does not provide transport for unaccompanied minors. They will board and take part in excursions, as well as nautical and aquatic activities, under the sole responsibility of their accompanying adult(s).

For children under two years of age, wearing a suitable life jacket is mandatory. Parents must inform Eco-Calanques (ENM) of their presence when booking or before boarding.

PASSENGER BEHAVIOUR:

While underway, passengers must remain seated. They must comply, during boarding and disembarkation as well as on board, with the ship's regulations, in particular those established by Eco-Calanques (ENM), and, more generally, follow the recommendations or instructions of the captain or their crew.

Eco-Calanques (ENM) declines all responsibility for any personal injury sustained by passengers who fail to comply with this requirement, whether on board or during boarding or disembarkation.

Passengers will be held liable for any damage of any kind that they may cause to themselves, to other passengers, to third parties, or to the personnel and property of Eco-Calanques (ENM).

The same applies to any damage of any kind caused by persons or property in the passengers' care.

Eco-Calanques (ENM) permits swimming during excursions as part of «swimming breaks» in the Calanques. However, this is unsupervised and takes place under the

passengers' own responsibility. On this occasion, minors remain under the responsibility of their accompanying adult(s). Persons who cannot swim or swim poorly must report this to the crew.

Eco-Calanques (ENM) provides passengers with buoys and floating life jackets.

Eco-Calanques (ENM) declines all responsibility in the event of incidents or personal injury occurring while swimming.

PERSONAL INJURY:

Any injury or damage occurring during excursions or nautical and aquatic activities must be reported by the passenger to Eco-Calanques (ENM) before leaving the boat.

In the event of injury to themselves and/or damage to their property (personal belongings, etc.), passengers must report this to the crew. Eco-Calanques (ENM) will draw up a joint report in the presence of the passenger(s) concerned before they leave the boat. Failure to comply with this requirement will mean passengers are deemed to have disembarked safe and sound, with their belongings in good condition.

Eco-Calanques (ENM) disclaims all responsibility, outside of the cases provided for by articles L5421-2 and following of the Transport Code, for personal accidents occurring during navigation, excursions or nautical and aquatic activities, or during boarding or disembarkation, whether at the ports of departure or destination, at ports of call, or at sea while swimming.

PERSONAL ITEMS OR EQUIPMENT:

Passengers may bring their personal equipment (camera, mask, snorkel, fins) on board at their own risk.

Eco-Calanques (ENM) declines all responsibility concerning luggage, personal item(s) or equipment brought aboard by passengers, as well as for money, jewellery or other valuables kept during excursions and any other activity offered by Eco-Calanques (ENM), which remain under the exclusive responsibility of their owners.

LOAN OF EQUIPMENT FREE OF CHARGE:

Eco-Calanques (ENM) provides passengers, free of charge, with equipment for the nautical and aquatic activities it offers (fins, masks, snorkels, underwater cameras, windbreakers, shorty wetsuits, etc.).

Where applicable, defects in the equipment do not entitle passengers to any refund or discount.

Eco-Calanques (ENM) reserves the right to take legal action against passengers who have deliberately damaged or degraded equipment lent free of charge.

ORGANISATION OF FESTIVE EVENINGS AND EXCURSIONS:

As part of the festive evenings and excursions organised by Eco-Calanques (ENM) (cocktails, evenings in the Calanques, hen or stag parties, etc.), moderate consumption of alcohol and tobacco is permitted.

For reasons of safety and passenger comfort, Eco-Calanques (ENM) staff may limit or prohibit the consumption of alcohol, tobacco or drugs.

Eco-Calanques (ENM) may take any steps or restrictions necessary regarding passengers whose behaviour:

Endangers a person or a member of staff, damages or deteriorates property belonging to Eco-Calanques (ENM), prevents staff from carrying out their duties, or fails to comply with the recommendations and instructions of staff members or the captain.

Eco-Calanques (ENM) reserves the right to disembark passengers whose behaviour compromises the safety, tranquillity or comfort of other passengers or staff members.

Financial conditions

The descriptions of the Services presented on the Site specify, for each service, what is included in the price. Prices are shown in Euros. Prices generally include all applicable taxes, fees and related service costs.

Payments made on the Site are by bank card (Carte Bleue, Visa, Eurocard/Mastercard and American Express cards are accepted) through a secure payment system.

In the event that payment proves to be irregular, incomplete or non-existent for a reason attributable to you, the sale of these services will be cancelled, with any resulting costs being your responsibility, and civil and/or criminal proceedings may, where applicable, be brought against you.

CANCELLATION TERMS FOR YOUR EXCURSION

- Due to Eco-Calanques (ENM):

If, due to bad weather conditions, the excursion could not take place, you would be fully reimbursed for any sums paid, with no charges being retained.

– Due to the client:

If, for personal reasons, you choose to cancel your excursion one month before the date of the excursion, your deposit will be refunded and no charges will be incurred.

Should you need to cancel your excursion between 15 days and one month before the date of the excursion, your deposit will not be refunded (up to a maximum of 30% of the total cost of the excursion).

Should you need to cancel your excursion less than 15 days before the date of the excursion, the full amount received will remain with us.

INTELLECTUAL PROPERTY

Eco-Calanques (ENM) holds all intellectual property rights relating to the Site, which belong to them or for which they hold usage rights.

Access to the Site does not grant you any rights over the intellectual property rights relating to the Site, which remain the exclusive property of Eco-Calanques (ENM).

The elements accessible on the Site, particularly in the form of text, photographs, images, icons, maps, sounds, videos, software, databases and data, are also protected by intellectual property rights.

Except where explicitly stated otherwise in this document, you may not, under any circumstances, reproduce, represent, modify, transmit, publish or adapt, on any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever, all or part of the Site without the prior written authorisation of Eco-Calanques (ENM).

DELAY
